Welcome to Swift Convo! By accessing or using our website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Accounts

To use our Service, you must create an account. You agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:

• Send spam, unsolicited bulk messages, or messages that violate WhatsApp's Commerce and Business Policies.
• Use the Service to transmit illegal, harmful, or offensive content.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate your account if you violate these restrictions.

3. WhatsApp Business Policy

Our Service utilizes the WhatsApp Business API. You agree to comply with all applicable Meta and WhatsApp policies, including the WhatsApp Business Messaging Policy and Commerce Policy. Violations of these policies may result in the suspension of your WhatsApp Business Account by Meta, for which Swift Convo is not liable.

4. Payments and Subscription

Swift Convo offers paid subscription plans. By selecting a plan, you agree to pay the applicable fees. Fees are billed in advance on a monthly basis and are non-refundable, except as required by law.

• Free Trial: We offer a 7-day free trial. You may cancel at any time during the trial to avoid being charged.
• Plan Upgrades/Downgrades: Changes to your plan will take effect immediately or at the start of the next billing cycle, depending on the specific change.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Swift Convo and its licensors. You may not copy, modify, or distribute any part of our intellectual property without prior written consent.

6. Limitation of Liability

In no event shall Swift Convo, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
